The defendant, Michael Brooks, was charged by grand jury indictment with two counts of distribution of cocaine, in violation of LSA-R.S. 40:967A(1). He pled not guilty and elected trial by jury. Subsequently, Count 2 was amended to a charge of distribution of a counterfeit controlled dangerous substance (counterfeit cocaine), a violation of LSA-R.S. 40:967A(2).
