I. INTRODUCTION

On January 26, 1993, the grand jury for the District of Delaware returned an indictment against defendants, Edward C. McCoy (hereinafter "defendant McCoy" or "defendant") and David L. Odom, charging them with: (1) four counts of knowingly providing false information in connection with the purchase of ten firearms in violation of 18 U.S.C. §§ 922(a)(6) and 924(a)(1)(B);
