MEMORANDUM OPINION AND ORDER

ASPEN, District Judge:

Plaintiff Ted Koutsoubos ("Koutsoubos") brings this action against defendants James A. Regas ("Regas") and the law firm of Regas, Frezados & Harp ("RFH") for aiding and abetting breach of fiduciary duty and fraud.
