PEOPLE v. MILLER

193 A.D.2d 1087 (1993)

600 N.Y.S.2d 669

The People of the State of New York, Respondent, v. Mark Miller, Appellant

Appellate Division of the Supreme Court of the State of New York, Fourth Department.

May 28, 1993

Judgment unanimously affirmed.

Memorandum:

We find that there is no basis to disturb the jury's determination to credit the testimony of the People's witnesses rather than that of defendant's witnesses. We conclude, therefore, that defendant's conviction was not against the weight of the evidence (see, People v Bleakley, 69 N.Y.2d 490, 495).
