Defendant, Billy Ray Smith, Jr., was indicted for attempted second degree murder of Paula Leverette in violation of LSA-R.S. 14:27 and LSA-R.S. 14:30.1A(1). After his first trial ended in a mistrial, defendant was found guilty by a 12 person jury on May 21, 1992. On December 1, 1992, the defendant was sentenced to serve a term of 480 months at hard labor with the Louisiana Department of Corrections. Defendant now appeals his conviction and sentence...
