Following his conviction by a Fayette County jury of first-degree assault and the imposition of a sentence of imprisonment for ten years, the defendant, Allen Hocker, Jr., appealed to the Court of Appeals. A divided panel of that court reversed the conviction and remanded for a new trial, holding that the evidence was insufficient as a matter of law to sustain the conviction.
