Memorandum:

Defendant was convicted of one count of criminal sale of a controlled substance in the second degree and three counts of criminal possession of a controlled substance in the third degree. The charges arose from two separate incidents. On August 6, 1990, an undercover investigator arranged to purchase cocaine from one Alphonse Napoli. He went to Napoli's home and, according to the undercover investigator's testimony...
