Justice McNULTY delivered the opinion of the court:

Defendant Adam Barragan was indicted for murder (720 ILCS 5/9-1 (West 1992)). After a jury trial by the circuit court of Cook County, defendant was convicted and sentenced to 40 years' imprisonment. The trial began on September 25, 1990. Defendant's motion for new trial was denied by the court. A timely notice of appeal was filed.
