We granted Maupin's Rule 11 Application to decide whether the double jeopardy clauses of the Tennessee or United States Constitutions forbid retrial of lesser included offenses under the circumstances presented. The Defendant, Denise Maupin, was convicted by a jury of aiding and abetting the first degree child abuse murder of her two-year-old son, Jay Michael Maupin, and was sentenced to life imprisonment.
