Appellant Donald Blankenship, Jr., filed a wrongful termination action against his former employer, respondent O'Sullivan Plastics Corporation. The gravamen of Blankenship's complaint is that O'Sullivan wrongfully discharged him for refusing to sign a substance abuse agreement that included a provision perceived by Blankenship as a waiver of his constitutional right against self-incrimination.
