On May 28-29, 1991 an uprising occurred among the inmates being held in exercise pens in the A-block of Southport Correctional Facility in Chemung County. As a result of his activities during the uprising, petitioner was found guilty after a Superintendent's hearing of violating State-wide rules prohibiting rioting and leaving an assigned area without authorization.
