Helms Family Trust ("Helms"), challenges the issuance of a wastewater discharge permit by the Nevada Division of Environmental Protection (NDEP) to respondent Douglas County. Helms' challenge stems from the purportedly invalid action taken by the Douglas County Board of County Commissioners changing the site of a proposed regional wastewater treatment facility.
