This is an appeal from a summary judgment. Appellants, Kim and Benefrida Smith, filed suit against appellee, Dr. Tam Nguyen, and Memorial Southwest Hospital for alleged medical malpractice during the birth of their minor son, Bryant. The hospital was dismissed from the lawsuit and is not a party to this appeal. After the Smiths failed to timely designate experts, the trial court granted Dr. Nguyen's Motion for Summary Judgment.
