Robert E. Johnson (hereinafter decedent) died on or about August 13, 1989 while an inmate in the Albany County Jail, where he had been confined from mid-July 1989. The cause of death was asthmatic bronchitis. Without filing a notice of claim, plaintiff, as the mother of one of decedent's three children, commenced this action on August 9, 1990 in the capacity of an "applicant to be appointed Administratrix" of decedent's estate.
