The plaintiff, Stanley U. Robinson, III, appeals from a judgment dismissing his amended complaint on the motion of the defendant, the Department of Public Utilities (DPU). The DPU based its motion, in part, on Mass. R. Civ. P. 12 (b) (1), 365 Mass. 755 (1974). Robinson asserts that it was error to dismiss his amended complaint on jurisdictional grounds. See Mass. R. Civ. P. 12 (b) (1). For the reasons stated herein, we conclude that the DPU did not err...
