STATEMENT OF THE CASE

The appellant was charged by bill of information with possession of crack cocaine, a violation of La.R.S. 40:967(C)(2). He was tried by a jury and found guilty as charged. The appellant was found to be a multiple offender and following a pre-sentence investigation, he was sentenced to serve forty months at hard labor as a multiple offender.
