Johnile L. Dubois pled guilty to a series of criminal indictments including capital murder. Pursuant to a plea agreement, the Commonwealth did not seek the death penalty. At the sentencing hearing, the trial court sentenced Dubois to death, finding that he would remain a continuing threat to society.
