The appellant, Wayne Daniel, was indicted by a Jefferson County grand jury for the offense of unlawful distribution of a controlled substance, in violation of § 13A-12-211, Code of Alabama 1975. A jury found the appellant guilty as charged in the indictment. The trial court ordered a presentence investigation and, on March 10, 1992, held a habitual offender hearing.
