The plaintiffs filed a single-count complaint against the defendant, Rakstang Associates, Inc. (Rakstang), seeking recovery under the Structural Work Act (Ill.Rev.Stat.1989, ch. 48, par. 60 et seq.) for the death of Michael A. Stanislawski. Rakstang moved for summary judgment pursuant to section 2-1005 of the Code of Civil Procedure (Ill.Rev.Stat.1989, ch. 110, par. 2-1005), contending that it was not in charge...
