OWENS v. NATIONAL BANK OF COMMERCE

1910952.

608 So.2d 390 (1992)

Patricia H. OWENS v. NATIONAL BANK OF COMMERCE.

Supreme Court of Alabama.

November 20, 1992.

Attorney(s) appearing for the Case

Earl Reuther of Davis & Goldberg, Birmingham, for appellant.

David O. Upshaw of Schoel, Ogle, Benton and Centeno, Birmingham, for appellee.

SHORES, Justice.

Patricia H. Owens appeals from a default summary judgment in favor of the plaintiff, National Bank of Commerce ("NBC"). We affirm.

In determining whether a summary judgment was properly entered, the reviewing court must view the evidence in a light most favorable to the nonmovant. See Turner v. Systems Fuel, Inc., 475 So.2d 539, 541 (Ala.1985); Ryan v. Charles Townsend Ford, Inc.,
