MEMORANDUM AND ORDER

JOHNSON, District Judge:

The defendant, Adebayo Yaya, was arrested on March 31, 1992 and arraigned the same day on a complaint. The arraignment resulted in the detention of the defendant. On May 1, the defendant was charged in a three count indictment. When Yaya was brought before Magistrate Judge Chrein to be arraigned, he sought dismissal of the indictment on the ground that the indictment had been filed beyond the thirty day period...
