This is an appeal from a judgment awarding damages to an operator of a fishing skiff for an injury that resulted from a collision with a cluster of piling located in a right-of-way obtained by defendant.

In September, 1988 Ferrell Buras and his cousin were travelling in a skiff on a canal in an area known as Tante Phine Pass south of Venice, Louisiana. The two men testified they were going bass fishing in the nearby bays and were transporting...
