On April 17, 1990, plaintiff-appellee, Yolanda Richerson, and her husband filed a complaint with the Summit County Common Pleas Court against defendantappellant, Cornelius Patten, alleging personal injuries suffered as a result of an automobile accident. On January 6, 1991, Cornelius Patten died, and the executrix of his estate was substituted as the party-defendant.
