STATON, Judge.

John Wera appeals his conviction of child molesting, a Class C felony.1 He presents five issues for our review:

I. Whether the trial court erred by declaring a mistrial as to Count I, child molesting, a Class B felony, rather than entering judgment on the evidence in favor of Wera. II. Whether there is sufficient evidence to support Wera's conviction of child molesting, a Class C felony (Count III).
