OPINION ON APPELLANT'S PETITION FOR DISCRETIONARY REVIEW

On February 28, 1990, appellant, Donald Cartwright, was convicted of delivery of a controlled substance in Orange County. The jury assessed punishment at forty years' confinement and a five thousand dollar fine. On appeal he complained that the trial court erred in permitting the jury to assess a fine which exceeded that authorized by law. The Ninth Court of Appeals at Beaumont affirmed...
