CROW, Judge.

A joint tenant of real estate sought partition of it. The trial court entered "Judgment" ordering the property sold and specifying how the net proceeds should be divided. The suing party died before the sale could be held. The trial court ruled the death rendered the suit moot, and dismissed it. That ruling is the subject of this appeal. The pertinent facts follow.
