THOMAS, Justice.

The State of Texas appeals from a trial court's order that suppressed certain evidence in its driving-while-intoxicated (DWI) case against Scott Russell Schaeffer. In two points of error, the State claims that the trial court abused its discretion when it suppressed (1) the audio portion of appellee's videotape and (2) the results of appellee's breath test.
