MALONEY, Justice.

Appellant and the State jointly moved to remand this cause for a new punishment trial under rule 80(c). See Tex.R.App.P. 80(c). We deny the parties' joint motion.

The jury convicted appellant of theft of property over the value of $20,000 and assessed a 20-year sentence on June 14, 1991. Appellant's timely filed motion for new trial was overruled by operation of law. This...
