Defendant Joe Marks was charged by indictment with one count of theft by deception and one count of conspiracy to commit theft. Defendant was tried in absentia and the jury found him not guilty of theft and guilty of conspiracy. The trial court sentenced defendant to an extended term of six years imprisonment and ordered that defendant and a co defendant, Lena Wilson, should "jointly and severally" pay restitution in the amount...
