SPINDEN, Judge.

This is a wrongful death action against Robert A. Berdella, Jr., for the deaths of three of four individuals he held captive and tortured to their deaths. Berdella pleaded guilty to first degree murder in connection with the death of Robert Allen Sheldon and second degree murder in connection with the deaths of James Ferris and Jerry D. Howell.
