When laid out in 1971 as part of a proposed subdivision, lot 40 (the "locus") conformed to the dimensional requirements of the zoning by-law of Wareham. Nine days after the preliminary plan for the proposed subdivision (it disclosed seven lots on a point projecting into Buzzards Bay) was filed with the Wareham planning board, the inhabitants of the town, on June 21, 1971, adopted an amendment to their zoning by-law requiring larger area and more frontage...
