This case brings to the Court a question as to the propriety of allowing a motion for summary judgment in an action for personal injury based on negligence. When a defendant moves for summary judgment in such a case and supports the motion with a forecast of evidence that would entitle him to a directed verdict if the evidence were offered at trial, the defendant is entitled to have his motion allowed unless the plaintiff makes a forecast of evidence...
