Royce D. Allen, appellant, was convicted by the court in the Circuit Court for Worcester County of possession of marijuana and possession of a noncontrolled substance with the intent to distribute it as a controlled dangerous substance. Appellant was sentenced to a term of 20 months imprisonment on the noncontrolled substance conviction, and the court merged the marijuana conviction. Appellant's notice of appeal was duly filed.
