I respectfully dissent from the majority's determination to affirm those judgments resolving plaintiffs' claims against the individual defendant, Bernard Grandis. In my view, the court erred in denying plaintiffs' CPLR 4404 (a) motion for judgment notwithstanding the verdict against Grandis. I thus would modify the judgments on appeal...
