Plaintiff, Melvin Saxton, instituted this action seeking recovery for personal injuries allegedly sustained as a result of negligent medical treatment by defendant, Toussaint G. Toole, M.D. After the jury returned a verdict for defendant, the trial judge granted plaintiff's motion for a new trial. During the subsequent trial, the court entered a directed verdict in favor of defendant at the close of the plaintiff...
