The defendant, Stanwood Les King, appeals from a judgment of the Superior Court (Hancock County, Silsby, J.) vacating a decision of the Southwest Harbor Zoning Board of Appeals that denied plaintiff Peter Boisvert's appeal of the issuance of a building permit to King. Because we conclude that the timeliness of Boisvert's appeal to the Zoning Board cannot be determined on the state of this record, and that the timeliness issue should be resolved...
