The appellant, Kelly Joseph Sparrow, was charged in a two-count indictment with sexual abuse in the first degree and sodomy in the first degree. He was convicted of both offenses and was sentenced to ten years' imprisonment on the sexual abuse conviction and to 25 years' imprisonment on the sodomy conviction, with the sentences to run consecutively.
