Justice CHAPMAN delivered the opinion of the court:

Stephanie Williams was killed on September 15, 1988, when the motorcycle upon which she was riding as a passenger collided with a tree which had fallen across the roadway. Stephanie was 15 years old at the time of the accident. She was survived by her father DeWayne Williams and her mother Anita Kratz.

DeWayne and Anita divorced in 1975 and DeWayne had custody of Stephanie until her death. DeWayne was appointed...
