Robert Clinton Smiley, the appellant, was charged in a single indictment with ten counts of robbery in the first degree. These charges were based on five separate robberies of store cashiers that occurred in Decatur in late October 1990. At the close of its case-in-chief, the State moved to dismiss the two charges relating to one of the robberies because the victim of that particular robbery did not appear at trial...
