MEMORANDUM OPINION AND ORDER

SPORKIN, District Judge.

This case comes before the Court on the Defendants, U.S. Department of the Navy's ("Navy"), Motion to Dismiss or in the Alternative for Summary Judgment. Because this Court finds that there are no genuine issues of material fact and that the Defendants are entitled to judgment as a matter of law, the Defendants' motion for summary judgment is granted.
