The appellant Michael Anthony Lackey was convicted for the capital murder of 87year-old Nellie Ola Moultrie as defined in Ala.Code 1975, § 13A-5-40(a)(4) (murder/burglary). The trial court accepted the jury's recommendation and sentenced the appellant to life imprisonment without the possibility of parole. The appellant raises two issues on this appeal from that conviction.
