In the summer of 1988, the State Office of Parks, Recreation and Historic Preservation (hereinafter OPRHP) entered into an oral contract with claimant's employer to remove some trees in Lodi Point State Park in Seneca County. While engaged in this work on September 25, 1988, claimant, a tree surgeon, was injured when he fell from one of the trees.
