KENNEDY, J.

Roberto Garcia appeals his judgment and sentence for delivery of and possession with intent to deliver a controlled substance. Appellant claims that his constitutional right to due process was violated by his conviction of a crime not named in the information. Appellant also claims that the possession with intent to deliver charge should have been merged into the delivery charge, and that it was a violation of double jeopardy to convict him of both crimes...
