CLABORNE, Judge.

In 1988, Walter William Spear ("appellant") murdered his wife and two sons. He pled no contest to first-degree murder of his wife and children. In late 1988, the brother of the deceased wife was appointed personal representative of the estates and there was a finding that all three had died intestate.
