The City of New Orleans appeals from a judgment of the trial court denying their motion for a preliminary and permanent injunction and a ruling that 2241 St. Anthony Street had acquired legal non-conforming use status.

Nile Hamilton and his wife acquired the property located at 2241 St. Anthony Street in New Orleans in July of 1953. They operated the property as Hamilton's Sweet Shop. At that time, the area was zoned as a classification E-Neighborhood...
