WILKINS, J.

On September 5, 1973, the defendant fatally shot his mother while she was lying in bed. This court affirmed his conviction of murder in the first degree. Commonwealth v. Sires, 370 Mass. 541 (1976). Among other things, we rejected the defendant's argument that, because the trial judge did not suppress statements that the defendant had made to police officers, he was denied his rights under Miranda
