Defendant was charged with possession with intent to deliver marijuana, MCL 333.7401(2)(c); MSA 14.15(7401)(2)(c), and, following a preliminary examination, was bound over for trial. Thereafter, defendant moved to suppress the evidence against him. Following a hearing on defendant's motion, the trial court suppressed the evidence and entered an order dismissing this case.
