The key issue presented by this case is the effect of the Automotive Repair Act (ARA), RCW 46.71, on a criminal case for theft of property and services. Following a jury trial in Spokane County Superior Court, defendant Zebulen Pike was convicted of second degree theft for taking his own car from a mechanic without paying for the repairs. The Court of Appeals reversed, holding that the State failed to prove that Pike had taken the "property of another"...
