The appellant, Vernon Madison, Sr., was indicted on May 20, 1985, in Mobile County, in a two-count indictment for the capital offense of murder of a police officer while the officer was on duty or was performing an official or job-related act, knowing that the officer was on duty or was performing an official or job-related act, in violation of § 13A-5-40(a)(5), Code of Alabama 1975.
