Gregory Wayne Hollis was indicted for the offense of rape in the first degree, in violation of § 13A-6-61(a)(1), Code of Alabama 1975. The jury found Hollis guilty of the lesser included offense of sexual abuse in the first degree, and Hollis was sentenced to five years in the state penitentiary and was ordered to pay restitution in the amount of $138.85 to the victim.
